These Terms of Use ("Terms") govern your access to and use of the FarmsApp mobile application and any related services (collectively, the "Platform"). The Platform is operated by Zuari FarmHub Limited ("Zuari", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
You must be competent to contract under applicable law (for example, at least 18 years of age in India) to use the Platform. By using the Platform, you represent that you meet this requirement.
To place orders and access certain features, you may be required to register for an account using your mobile number and an OTP-based verification process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:
The Platform enables you to browse and purchase agricultural inputs and related products from Zuari and/or its authorised partners. All orders placed through the Platform are offers by you to purchase products subject to our acceptance. We may accept or reject any order in our sole discretion, including due to stock availability, pricing errors, delivery constraints, or suspected fraud.
Prices displayed on the Platform are inclusive/exclusive of taxes as indicated. You agree to pay the total amount shown at checkout using the available payment methods (including cash-on-delivery where supported). Additional terms may apply to certain payment methods and will be displayed at the time of transaction.
Estimated delivery timelines shown on the Platform are indicative and may vary due to product availability, location, logistics partner performance, and other operational factors. We reserve the right to cancel any order in whole or in part, including where delivery is not serviceable or commercially feasible. In such cases, any amount paid by you for the cancelled portion shall be refunded as per our applicable refund policy.
Return, replacement, and cancellation policies for specific products will be communicated on the product page, checkout page, or through support channels. Your use of the Platform is subject to such policies as may be updated from time to time.
You may be able to provide information, feedback, reviews, or other content through the Platform ("User Content"). You are solely responsible for your User Content and agree that it will not be unlawful, misleading, defamatory, obscene, offensive, or infringe any third-party rights. By submitting User Content, you grant Zuari a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute such content in connection with the Platform.
All rights, title, and interest in and to the Platform, including its content, features, logos, trademarks, and underlying software, are owned by Zuari or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to use any of our trademarks or other proprietary content except as expressly permitted by us in writing.
The Platform may integrate or interoperate with third-party services such as payment gateways, SMS/OTP providers, logistics partners, analytics providers, or customer support tools. Your use of such third-party services may be subject to their respective terms and privacy policies. We are not responsible for any acts or omissions of such third parties.
To the maximum extent permitted by law, Zuari and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claims arising out of or relating to the Platform or these Terms shall not exceed the amount paid by you, if any, for the specific transaction giving rise to such claim.
You agree to indemnify, defend, and hold harmless Zuari and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.
We may suspend or terminate your access to the Platform (in whole or in part) at any time, with or without notice, if we believe you have breached these Terms, engaged in fraudulent or illegal activity, or if we are required to do so by law or a competent authority.
Your use of the Platform is also governed by our separate Privacy Policy, which explains how we collect, use, disclose, and protect your personal information, including your mobile number, address, and transaction details. By using the Platform, you acknowledge that you have read and understood our Privacy Policy. The latest version of the Privacy Policy is available within the app and at the URL notified by us from time to time.
We may update these Terms from time to time. When we do so, we will update the "Last updated" date above and may notify you through the Platform or other appropriate means. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of India. You agree that any disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India, subject to any mandatory provisions of applicable law.
